We may collect and process the following data about you:

• Information provided voluntarily by you. For example, when you register for information, apply for a particular service or make a comment or complaint.

• Typically the data consists of name, address, date of birth, telephone numbers, email addresses, gender, data related to your state of fitness such as height – weight – body mass index or blood pressure.

We use your data to verify identification, administer and provide services, research and develop our services and for marketing with your explicit consent.

The information you have provided to The Health Grain Clean Cut Foods will be used to administer your meal plan.  Your data will not be held or stored outside of the European Union and it will not be sold.

The consequences of not completing the checkout forms and agreeing to this use of your personal information are that The Health Grain will be unable to process your food orders.

The Company is legally able to process your personal data:

• when you have freely and explicitly provided your consent to this processing or
• when the Company has a statutory duty to collect and process this information to provide the required service or undertake a statutory function.
• When your personal data forms part of a contract between you and the Company

The consequence of you not providing personal information to the Company is that the Company will be unable to process your enquiry, assessment or application.

Sharing of Personal Data

When you subscribe to our newsletter, we transfer your name and email address to MailChimp who we use to prepare the newsletter and you will find their privacy statement here.  We hope you find these newsletters useful but you can unsubscribe at any time by clicking the unsubscribe button at the bottom of the mail.

The information provided will be sensitively saved and destroyed according to our statutory requirements and retention policy.

Our site is intended for use by people resident in Northern Ireland only. Although it may be possible to access the website from other countries, we make no representation that our website is compliant with any legal requirements in force in any jurisdiction other than the United Kingdom, or that the content available on the website will be appropriate for users in other countries or states.

Collection Of Information 

In order to use our website and place an order, we require some information from you for the sole reason so that we can provide you with the best possible service. Any information collected by The Health Grain is collected in correspondence from you or your company; this may be via mobile, email or directly through our website. All communications may also be collected and stored particularly in regards to sales, support and accounts – including email.

Any information collected from The Health Grain customers is required to assist us and present us with the opportunity to provide the customer with the best possible product/service. Other information acquired is used to assist our staff in the development and to supply service references.

Please read this Terms of Service (“Agreement”) attentively before availing of any of the products or services provided by The Health Grain  By using this website and the products of  The Health Grain, you are in agreement with all the terms enclosed. If you do not agree to this compliance, your only option is not to avail of the service of The Health Grain. Our Privacy Policy is incorporated by reference into this Agreement.

Nutritional Disclaimer 

The Health Grain is not a medical institution and therefore we are inept to advise you on your medical health. We do not provide weight loss management or medical guidance, and all nutritional advice should be taken at the discretion and risk of the customer/visitor. Reliance on any information provided on The Health Grain website, including material posted by other visitors to the site, is solely at your own risk. Nutritional advice is subject to constantly evolving knowledge in relation to health science, nutritional science, and sports science. Although we base our training and nutritional tips on current studies and education, we do not guarantee that these reflect the most up to date research findings or knowledge. All educational content is for informational purposes only and is intended for generally healthy people above the age of 18. We cannot guarantee any results such as weight loss, lean mass gain, muscle gain or maintaining weight from our products.

Please note that the food may be prepared in an area that also contains nuts. If any of our meals include nuts as an ingredient, this will be stated clearly on the ingredients section of our menu and also on the container in which the meals are stored. If you have a specific allergy, it is your duty to read all the ingredients prior to consuming any of the meals prepared by The Health Grain.

Collection Services

For the customer’s convenience, we offer a collection service by which you choose a meal plan on our website and we deliver those meals to your selected location twice a week.

Order Deadline

If your order is placed past the order deadline (FRIDAY 11:59am) you will, unfortunately, miss order deliveries for the coming Sunday.

Legal

We reserve the right to disclose your personally identifiable information as required by law when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process.

Your Status
By placing an order through our website, you permit that:
1) You are legally capable of entering into binding contracts; and
2) You are at least 18 years old.

Payment 

Payment for all Products must be by PayPal as specified on our website.

Outside Our Control 

If events outside of our reasonable control cause the failure to perform, or delay in performance of any of the obligations under our Contract, The Health Grain will not be liable or take responsibility for this.

Allergens 

Some products and meals in our range contain nuts and other allergens. As a result, traces of these could be found in other products produced within our premises. If you have a specific allergy, it is your duty to read all the ingredients prior to consuming any of the meals prepared by The Health Grain. Whilst every care is taken, we cannot guarantee any products are free from genetically modified ingredients – such as nuts, nut derivatives or small bones in fish products.

Refunds

If on collection, you find that any products are damaged or are in an unacceptable condition, then you must inform us as soon as possible so that we have the opportunity to inspect the Product. We will not be responsible for any Product which is damaged or faulty as a result of your failure to store the Product appropriately. In the case that, at our discretion, we find that the Product collected is not up to standard, we will deliver replacement products to you immediately. There are no other refunds unless otherwise stated.
